English/Nat After nearly a year, the Microsoft antitrust case went to final arguments on Tuesday in a federal court in Washington D-C. Tuesday marked the last time lawyers will meet in the courtroom in this historic trial, prior to U-S District Judge Thomas Penfield Jackson's two-phase verdict, which could come as early as next month. Citing dozens of internal e-mails and sworn testimony already in evidence, government lawyers portrayed Microsoft as ruthless in trying to protect the dominance of its Windows software. Microsoft's flagship product runs most personal computers and is largely responsible for the vast wealth of the world's richest man, billionaire company chairman, Bill Gates. Speaking outside the court was the Justice Department's spokesman Joel Klein. SOUNDBITE: (English) "What the government said and did in terms of this case was to use principally Microsoft's contemporaneous documents in evidence. This is their story told by us, based on the facts as they occurred. Those facts show a monopolist engaged in predatory and anti competitive behaviour that was not simply its intent, ladies and gentlemen, that was its effect. They set out to accomplish what they wanted to do, which was to make sure that no one came near eroding their monopoly position on the Windows desktop operating system." SUPER CAPTION: Joel Klein, U.S. Justice Department In their closing arguments, the government pointed to the obvious dominance of Windows as evidence that the company wields monopoly power, a crucial legal test for its lawsuit. It also questioned the credibility of Microsoft's trial witnesses, often contradicted by company documents or other industry executives. Iowa's Attorney General, Tom Miller, said this trial was an exceedingly important consumer protection case. SOUNDBITE: (English) "The antitrust law assumes, presumes, that a monopolist will deny consumers, will make consumers less, will injure them by making less products, not as good a product at a higher price. This case demonstrates that extremely well." SUPER CAPTION: Tom Miller, Iowa Attorney General Inside the court room, Microsoft lawyer John Warden criticized what he called the government's "astounding failures of proof," together with "red herrings, lies, misstatements and omissions" presented during 76 days of courtroom testimony. Warden charged that the antitrust case, filed under the Sherman Act, was largely driven by complaints from Microsoft's jealous industry rivals, including America On-line Inc., the former Netscape Communications Corp., Sun Microsystems Inc., Apple Computer Inc. and IBM. Outside, his refrain was repeated by spokesman Bill Newcomb. SOUNDBITE: (English) "This is not the time for more hot air and hollow rhetoric. This case has been tried over a number of months. The record is what it is, the record shows that the government has failed to bring forward evidence to prove any allegations. The record shows that Microsoft's conduct has been and is pro-competitive and pro-consumer." SUPER CAPTION: Bill Neukom, Senior Vice-President and General Counsel for Microsoft. Microsoft challenged the notion that its actions have hurt consumers, and Warden denied that Microsoft ever discouraged the nation's computer makers and other companies from distributing Netscape's Internet software. SOUNDBITE: (English) SUPER CAPTION: Bill Neukom, Senior Vice-President and General Counsel for Microsoft. During the trial Judge Thomas Penfield Jackson interrogated both witnesses and lawyers. But before a packed courtroom gallery on Tuesday, he remained inscrutable through five hours of closing arguments. Hillary was raised in a suburb of Illinois where she attended public school and was raised a Methodist by her parents. She attended Wellesley College, and went on to study law at Yale. After attending Yale Law School, she went to work for the Children’s Defense Fund, going door to door in New Bedford, Massachusetts. After serving as a lawyer for the Congressional Committee investigating President Nixon, she moved to Arkansas where she taught law and ran legal clinics representing poor people. She co-founded Arkansas Advocates for Children and Families, one of the state’s first child advocacy groups. As First Lady under President Bill Clinton, Hillary tenaciously led the fight to reform our health care system so that all our families have access to the care they need at affordable prices. Hillary led the U.S. delegation to Beijing to attend the UN Fourth World Conference on Women and gave a groundbreaking speech, declaring that “human rights are women's rights and women's rights are human rights once and for all”—inspiring women worldwide and helping to galvanize a global movement for women’s rights and opportunities. Hillary was then elected to the U.S. Senate, becoming the first woman senator from New York. She repeatedly worked across the aisle to get things done, including working alongside Republicans after the terrorist attacks of September 11, 2001. When Congress wouldn't do enough for rural areas and small towns, Hillary didn’t back down. She launched innovative partnerships with the tech industry and provided support to local colleges and small businesses. When President Obama asked Hillary to serve as his secretary of state, she answered the call to public service once again. She was a forceful champion for human rights, internet freedom, and rights and opportunities for women and girls, LGBT people and young people all around the globe. Now she’s running for President because everyday Americans need a champion and she wants to be that champion. ABOUT THE HILLARY CLINTON YOUTUBE CHANNEL Welcome to Hillary Clinton’s YouTube Channel. CNN host Anderson Cooper on Monday zinged the president for reportedly considering firing special counsel Robert Mueller from the Russia investigation, jokingly suggesting “Jared Kushner could take it over.” The panel on “AC360” was discussing Newsmax CEO and Donald Trump confidante Chris Ruddy’s assertion that the president is “considering perhaps terminating” Mueller, who was appointed by Deputy Attorney General Rod Rosenstein last month to oversee the Russia probe. Cooper called the move “politically incomprehensible,” asking New Yorker’s Ryan Lizza about the ramifications of such a decision. Lizza explained that there is now “evidence of a potential crime” following former FBI Director James Comey’s testimony last week before the Senate Intelligence Committee, adding it’s now Mueller’s job to find out if the president obstructed justice. CNN’s Jeffrey Toobin, on the other hand, remained unconvinced that such a move would jeopardize Trump’s political standing. “What makes anyone think that the Republican party base would be upset about this at all?” Toobin asked. “Or the Republicans in Congress? What have the Republicans in Congress ever objected to that Donald Trump has done?” Toobin argued Republicans like Sen. John McCain (R-AZ) would be “very concerned” about the decision, but will quickly “move and then they’ll repeal healthcare,” adding the public would be hard-pressed to see “any real dissent” from the president’s party, “Anything [Trump’s] done has gotten some throat clearing, but everybody’s marching in lock-step,” Toobin later added. Former U.S. Attorney for the Southern District of Iowa Matt Whitaker pointed out if the president decides to follow through on firing Mueller it will put the probe “in the hands of the career professionals at the Department of Justice, which is not what this president wants, for sure.” “Jared Kushner could take it over,” Cooper joked. “It’s Middle East peace he’s taking care of,” Toobin reminded Cooper. CEDAR RAPIDS, IA (CBS2/FOX28)--Desecrating the American flag is now officially legal in Iowa. A federal judge has struck down two Iowa laws that made it a crime to mistreat the flag. The judge ruled the laws unconstitutional because they criminalize the right to free speech. This class of first graders at St. Jude Elementary School is learning about the pledge of allegiance and how to fold the American flag. "They pick up on it really fast when you explain to them what the whole thing is about,‚ said veteran Bob Feiereisen. He says he wants them to learn respect for the flag. The lesson comes in the wake of a ruling by a federal judge that makes it okay to desecrate the American flag in Iowa. "For those of us that have been in the service that's a pretty good way to start a fight,‚ Feiereisen said. It's a feeling these vets at the Veterans Welcome Center in Cedar Rapids echo. "To spit on a flag and to drag it on the ground to me is degrading and I think it's wrong,‚ said Shawn Dohrmann. The ruling stems from a 2013 lawsuit. As Westboro Baptist Church members protested during soldiers' funerals, police warned them they could be arrested for dragging an American flag on the ground or standing on it. They along with the help of the American Civil Liberties Union of Iowa challenged two Iowa laws that were originally passed to protect the American flag. "If we were to deny them the right to use the flag for expression then it follows that none of us could use it,‚ said Randall Wilson, Interim Executive Director and General Counsel. Veterans like Kevin Ringold say while the flag represents freedom, it's also a symbol of the many lives that were lost as a result of protecting that freedom. "Show some respect because you wouldn't be where you are, have what you have if it wasn't for that flag and the people who fought for it,‚ he said. A reminder these 1st graders are taking to heart by simply learning how to fold the red white and blue.
