The presentation will also discuss: discipline policies; documenting discipline; communicating the discipline decision; termination considerations; termination guidelines – establish and follow work policies, review and investigate; confirm treatment of similarly situated employees; evaluate the possibility of a discrimination or retaliation claim; documentation; and communicating decision to terminate. A question and answer period will conclude the presentation. Presenter Thomas A Evans regularly advises employers, including in-house counsel, senior management and human resources representatives, in many aspects of litigation, employee terminations, disability accommodation issues, wage and hour compliance, leaves of absence, employee discipline, internal investigations, wrongful termination, reduction-of-force, labor relations, collective bargaining, union avoidance and compliance with federal and state laws. He also represents employers in a full spectrum of employment law matters including interest and grievance arbitrations, prohibited practice complaints, negotiability disputes, amendment of bargaining unit, workers’ compensation and unemployment. Prior to joining Brown Winnick, Tom served as General Counsel for the Iowa Board of Regents. Tom practices primarily in the labor and employment area, with expertise in the collective bargaining area. While with the Board of Regents (2004-2015) Tom represented the Board and Iowa’s public universities and special schools (K-12) in collective bargaining, and labor relations matters. English/Nat After nearly a year, the Microsoft antitrust case went to final arguments on Tuesday in a federal court in Washington D-C. Tuesday marked the last time lawyers will meet in the courtroom in this historic trial, prior to U-S District Judge Thomas Penfield Jackson's two-phase verdict, which could come as early as next month. Citing dozens of internal e-mails and sworn testimony already in evidence, government lawyers portrayed Microsoft as ruthless in trying to protect the dominance of its Windows software. Microsoft's flagship product runs most personal computers and is largely responsible for the vast wealth of the world's richest man, billionaire company chairman, Bill Gates. Speaking outside the court was the Justice Department's spokesman Joel Klein. SOUNDBITE: (English) "What the government said and did in terms of this case was to use principally Microsoft's contemporaneous documents in evidence. This is their story told by us, based on the facts as they occurred. Those facts show a monopolist engaged in predatory and anti competitive behaviour that was not simply its intent, ladies and gentlemen, that was its effect. They set out to accomplish what they wanted to do, which was to make sure that no one came near eroding their monopoly position on the Windows desktop operating system." SUPER CAPTION: Joel Klein, U.S. Justice Department In their closing arguments, the government pointed to the obvious dominance of Windows as evidence that the company wields monopoly power, a crucial legal test for its lawsuit. It also questioned the credibility of Microsoft's trial witnesses, often contradicted by company documents or other industry executives. Iowa's Attorney General, Tom Miller, said this trial was an exceedingly important consumer protection case. SOUNDBITE: (English) "The antitrust law assumes, presumes, that a monopolist will deny consumers, will make consumers less, will injure them by making less products, not as good a product at a higher price. This case demonstrates that extremely well." SUPER CAPTION: Tom Miller, Iowa Attorney General Inside the court room, Microsoft lawyer John Warden criticized what he called the government's "astounding failures of proof," together with "red herrings, lies, misstatements and omissions" presented during 76 days of courtroom testimony. Warden charged that the antitrust case, filed under the Sherman Act, was largely driven by complaints from Microsoft's jealous industry rivals, including America On-line Inc., the former Netscape Communications Corp., Sun Microsystems Inc., Apple Computer Inc. and IBM. Outside, his refrain was repeated by spokesman Bill Newcomb. SOUNDBITE: (English) "This is not the time for more hot air and hollow rhetoric. This case has been tried over a number of months. The record is what it is, the record shows that the government has failed to bring forward evidence to prove any allegations. Two comedians posed as surfer bros at the hearing, testifying against a city proposal to crack down on house parties. Calling himself a “house party enthusiast,” Chad Kroeger urged council members to abandon a plan to regulate the parties, which have brought widespread complaints about traffic and noise. Kroeger, who spoke with a Jeff Spicoli-inspired accent, recounted one high school party where he downed a “tall can of Bud Light,” an experience that later gave him the confidence to ask a girl to prom, he said. “House parties were the bedrock of my development as a young man in San Clemente,” said a sincere-sounding Kroeger. His pal, JT Parr, testified that the country’s deep divisions could be solved with “a fricking rager.” Kroeger and Parr are played by Tom Allen and John Parr, two West Hollywood-based comedians who run a web series called “Chad Goes Deep.” They have also testified at a San Clemente City Council meeting to urge leaders to commemorate the late actor Paul Walker by chiseling his image into a coastal bluff. Their appearance Wednesday was their first visit to the L.A. City Council. “Whenever we see an issue that speaks to us, we know we have to go," Allen said in an interview Friday, adding that they plan to return for future hearings on the house party issue. City Council President Herb Wesson, who is known for running a brisk meeting, acknowledged the pair and their act with a smile before moving on to the next speaker. “Thank you, thank you,” he said. “And I want to welcome you to L.A. One of the biggest mistakes I see individuals involved in custody matters make is to let their personal animosity towards the other parent take precedence to the best interests of their child. Candidly, the courts care very little about why the parents decided to separate. They do however, look very close at which parent is putting the Children's best interests first. You should not disrespect or talk negative about the other parent to or in front of your children. This will hurt you in your custody case and worse still it will hurt your children. Even if you normally have good self-control these emotional types of situations can happen in a flash. It only takes one dumb move done out of anger, like pushing the other parent who is holding the baby at the time to lose custody. Once Custody is lost, you may never recover it. Also remember that anything you say, write down or put in electronic form on the internet may be used against you. Always assume your words and a judge will see written statements. Child custody cases are very emotional and when parent tensions run high and these emotions can lead to ugly verbal confrontations at the very least and actual physical violence at the very worst. You may make rash decisions that can harm your case or narrow your options in your case. Avoid these at all cost and in these situations just walk away.
